Our practice is divided into two sections: 1. Commercial Law and 2. Construction Law. In respect of Commercial section we have the necessary skills and expertise in the negotiating, settling and drafting of various types of Commercial Contracts and the conducting of successful Commercial Arbitration and/or Litigation. We are also involved in the takeovers and mergers of large corporations and in particular are involved in the restructuring of companies so as to enable them to comply with the Broad-Based Black Empowerment Legislation of South Africa. Broad-Based Black Economic Empowerment (B-BBEE) is a strategic imperative for many businesses particularly those impacted by public sector procurement, licensing and concessions, grants and incentives and private-public partnerships. Franke and Associates has together with its connectivity to verification and compliance companies, the necessary expertise to assist various businesses to ensure that they comply with The Amended Codes of Good Practice, for Broad-Based Black Economic Empowerment. We assist in creating and facilitating new investment opportunities and structuring of joint ventures and collaborations between various business entities. In respect of that section of the practice which deals with Construction Law we have the necessary skills and expertise in the negotiating, settling and drafting of large construction contracts based on inter-alia the NEC (New Engineering Contract); FIDIC (Federation International des Ingenieurs-Conseils -International Federation of Consulting Engineers); and JBCC (The Joint Building Contracts Committee) contracts as well as the arbitration and litigation of building related disputes. In both these sections within which we practice we understand the fine line between legal certainty and commercial reality when drafting and negotiating contracts. Further although we understand that disputes cannot always be avoided in construction projects and commercial transactions, one of our key objectives is dispute avoidance and dispute resolution.
